Terms of Service

These Terms govern your access to and use of ConfluenceMeter (the “Service”). By creating an account or using the Service, you agree to these Terms.

2. What the Service is (and is not)

ConfluenceMeter is an online software product designed to help users monitor indicator confluence, manage watchlists, and define alert rules based on configurable thresholds and timeframes. It may display prices, percentage changes, and derived scoring based on available market data.

Trading / financial disclaimer (read carefully)

  • ConfluenceMeter is not a broker, exchange, or execution venue and does not place trades.
  • ConfluenceMeter does not provide financial advice, investment recommendations, or “signals” you should follow.
  • The Service does not guarantee any performance, outcome, profit, or risk reduction. Trading involves substantial risk, including total loss of capital.
  • You are solely responsible for how you interpret and use information from the Service and for complying with applicable laws and regulations.

3. Key features (product scope)

The Service may include the following functionality (availability and limits may depend on your plan):

  • Confluence score views across multiple timeframes.
  • Watchlist management (add/search/sort/favorites/pinning).
  • Alert rules with configurable scope (specific symbol vs. any symbol), timeframe selection, and conditions (bullish/bearish/neutral-exit).
  • In-app alert history and filtering (direction, ranges, pagination/load more).
  • Rule management (create/edit/pause/duplicate/delete).

We may add, remove, or modify features over time. We do not promise that any particular feature will remain available indefinitely.

4. Eligibility and accounts

  • You must be at least 18 years old to purchase a subscription.
  • You are responsible for safeguarding your credentials and any activity that occurs under your account.
  • You must not misrepresent your identity or use the Service to impersonate others.

5. Plans, limits, and fair use

Plans may include usage limits such as number of watchlist symbols, number of alert rules, and history windows. We may enforce these limits through product controls.

We also apply “fair use” protections to prevent abusive usage (e.g., excessive automated requests, scraping, attempts to bypass restrictions) that could degrade the Service for others.

6. Payments, subscriptions, and Paddle (Merchant of Record)

Payments for subscriptions are processed by Paddle as Merchant of Record. This means Paddle handles payment processing, tax calculation where applicable (e.g., VAT), and issuing receipts/invoices in accordance with its obligations.

Subscriptions typically auto-renew until canceled. Canceling stops future renewals and usually keeps access until the end of the current paid period, unless stated otherwise at checkout.

7. Refunds

Our refund policy is described in the Refund Policy. Refunds are processed under Paddle’s framework and may be subject to fraud checks and eligibility rules.

8. Market data and third‑party dependencies

The Service may rely on third-party data sources and infrastructure. Market data can be delayed, incomplete, or inaccurate. We do not guarantee the timeliness or correctness of market data, scores, alerts, or computed outputs.

You should confirm critical information independently (e.g., via your broker/exchange) before acting.

9. Acceptable Use Policy (AUP)

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes.
  • Scrape, crawl, reverse engineer, or attempt to extract source code or proprietary methods.
  • Bypass plan limits, manipulate the Service, or interfere with its stability and security.
  • Share accounts in a way that effectively resells or redistributes access.
  • Upload or transmit malware, abuse the API (if any), or perform unauthorized load testing.

We may suspend or terminate accounts involved in abuse or suspected abuse.

10. Intellectual property

The Service, including its software, design, trademarks, and content, is owned by the Provider or licensors. You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own lawful purposes, subject to these Terms.

11. Feedback

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation, to improve the Service.

12. Availability, changes, and maintenance

The Service is provided “as available.” We may perform maintenance, updates, or changes that can affect availability or functionality. We do not guarantee uninterrupted availability.

14. Disclaimers of warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or business opportunities.

Our total aggregate liability for any claims arising out of or related to the Service will not exceed the amount you paid for the Service in the three (3) months immediately preceding the event giving rise to the claim.

Nothing in these Terms limits non-waivable consumer rights where applicable.

16. Indemnification

You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses arising from your misuse of the Service, violation of these Terms, or violation of applicable law.

17. Suspension and termination

We may suspend or terminate your access if you violate these Terms, if we reasonably suspect fraud or abuse, or if payment fails and is not remedied. You may stop using the Service at any time.

18. Governing law and jurisdiction

These Terms are governed by the laws of Spain. Where you are a consumer, you may benefit from mandatory consumer protections and jurisdiction rules under applicable law.

19. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date will reflect the latest version. Continued use of the Service after changes become effective constitutes acceptance.
